Its an interest and performance balancing act. Like property and other disputes covered herein, Contract matters can benefit from overall flexibility and creative problem-solving that is inherently fair. 

Contract claims can be solved by a new contract or modification of existing contract terms. In either case it is the Mediated result that produces the terms of a Mutual Acceptance Agreement (MAA) which must be fair and unbiased to be voluntarily signed in the mediation process. Furthermore, the MAA has to address all the issues to be complete because anything short of a complete agreement, is no agreement at all (this is the basic understanding used to create binding contracts).
