The Mediation Process
 

Private Meetings: Before the day of the Mediation the mediator meets separately with each party to discuss strengths, weaknesses, and bottom lines (included in the flat rate).

Transparent  Mediation: The mediator explains the rules of respect and cooperation in the process. The Mediator then lists and explains the areas where there is mutual agreement that already exist and each side then offers their view of the individual matters that are still in in dispute.

Negotiation: Parties may do it together or may be asked separately to trade offers through the mediator to build a fair agreement.

Resolution: The parties then have their attorneys review the agreement and then sign the mutual terms of their resolution agreement.

Control over the terms of  agreement is far more enriching than a battle to the finish… which in reality may not end for a long, long time. Meetings with both sides privately are all included in one flat rate for the entire Mediation process.

Court Finalization: Judges can then take your privately negotiated resolution agreement (such as a Divorce Agreement) and make it a finalized legal document. When the judge signs it into law as a legally binding court approved agreement, you are done—fair, fast and inexpensive. 

A Neutral Mediator investigates the relevant issues at the individual meetings and explores the needs and flexibilities which are refined through the mediation process. We know in the end a Mediated resolution has to be fair, unbiased and complete because it will ultimately be the parties mutual agreement.
